Terms and Conditions

1. Application and Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Anastasiia Strauss (hereinafter referred to as “3DPlan.online”) and her clients (hereinafter referred to as the “Client”) concerning the creation and provision of 2D and 3D floor plans.The following terms apply to orders placed through our online shop by businesses.

The following terms and conditions apply to orders placed through our online shop by both consumers and business customers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.

An entrepreneur is any natural or legal person, or a legal partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or independent professional activity.

2. Description of Services

3DPlan.online provides professional graphic services, specifically the digitization of 2D real estate floor plans into presentation-ready 2D and 3D plans. Services include:

  • 2D floor plans with dimensions
  • 2D floor plans with furniture
  • 3D floor plans with furniture

Only those services and products explicitly specified in your order or contract will be provided.

3. Conclusion of Contract / Order

The purchase contract is concluded directly with 3DPlan.online. The display of products in the online shop does not constitute a legally binding offer but is an invitation to submit an order.

You may initially add products to the shopping cart without obligation and may adjust your entries at any time before submitting a binding order using the provided editing tools.

The contract is concluded once you accept the offer for the products in your shopping cart by clicking the “Order” button. Immediately after submitting the order, you will receive confirmation by email along with an invoice for payment.

By making the payment, you confirm your agreement with the terms of service provided by 3DPlan.online.

Any changes or additions to the order after submission are only possible with our consent.

4. Prices and Payment

All prices are stated in Euro (EUR) and are valid only for payments in Euro. No VAT is charged (§6 para. 1 Z 27 UStG).

For payments in other currencies, 3DPlan.online reserves the right to charge an additional fee related to currency conversion and bank charges.

Payment must be made 100% in advance via bank transfer. Our bank details will be provided in a separate email.

Delivery or provision of services will occur only after full payment has been received.

5. Execution Times and Delivery

The standard execution time for 2D and 3D floor plans (for 1–10 rooms per floor) is 4–5 days.

Orders are delivered in PNG format (JPG upon request) via a download link.

Execution times may vary depending on the scope and complexity of the project. In particular, if there are more than 10 rooms or a large workload, the production time may be extended. In such cases, 3DPlan.online will inform the client of the expected execution times before issuing the invoice.

In case of delays caused by missing supplementary information from the client, force majeure, or other circumstances beyond our control, the delivery time will be extended accordingly.

Time required for corrections is not included in the stated 4–5 days and is considered additional working time.

6. Rights to Materials and Intellectual Property

Upon full payment, the usage rights are transferred to the client for private or commercial use within the scope of the agreed order.

The designer reserves the right to use the work for portfolio purposes, self-promotion, and marketing while maintaining confidentiality and without disclosing the client’s address or other personal data.

7. Withdrawal and Termination

Entrepreneurs do not have a statutory right of withdrawal.

8. Disclaimer

The provided 2D and 3D floor plans are the result of computer-generated graphic processing and serve exclusively visual and illustrative purposes. They do not constitute real photographs and may differ from the actual condition of the property.

The graphic materials are created based on plans, measurements, photographs and other information provided by the client. 3DPlan.online assumes no liability for the accuracy or completeness of the source data supplied by the client.

The visualizations do not constitute construction, architectural or technical planning documentation and may not be used as construction or engineering documents.

The representations are indicative only and are created without detailed architectural modelling, based on standard 3D models of furniture, decorative elements and structural components.

3DPlan.online shall not be liable for any inability to use the delivered files for reasons beyond its control (including technical limitations of the client’s hardware or software).

Towards Entrepreneurs (§ 1 UGB):

3DPlan.online shall not be liable for slight negligence.
Liability for intent and gross negligence shall remain unaffected.
Liability for loss of profit, consequential damages and indirect damages shall be excluded to the extent permitted by law.

Towards Consumers (§ 1 KSchG):

3DPlan.online shall be liable for damages resulting from injury to life, body or health in accordance with statutory provisions.

For other damages, 3DPlan.online shall only be liable in cases of intent or gross negligence.

In cases of slight negligence, 3DPlan.online shall only be liable for breach of essential contractual obligations and limited to the damage typically foreseeable under the contract.

Mandatory statutory liability provisions shall remain unaffected.

9. Client Cooperation

2D and 3D floor plans are created based on the plans, dimensions, photographs, and other specifications provided by the client.

The client undertakes to provide all documents and information required for proper service provision in a timely manner. This includes, in particular:

  • Photos of sufficient quality
  • Floor plans and construction drawings
  • Material preferences and technical project specifications
  • Other information at the designer’s discretion

The client is obliged to notify the service provider immediately if previously supplied information is incomplete or incorrect and to provide correct data without delay.

In the event that incorrect, incomplete, or delayed information is provided, the Client shall bear full responsibility for any changes in the quality of the result as well as for any extension of the performance period.

In such cases, the standard execution period (4–5 days) shall be extended by the time required to obtain and process the missing information.

10. Corrections, Warranty and Data Retention

10.1 Limitation of Corrections

A limited number of corrections is provided under this Agreement.

The parties agree that two rounds of corrections are included in the agreed remuneration.

Any additional changes or corrections exceeding this limit shall be carried out exclusively against separate remuneration based on prior written agreement.

The processing time for corrections is not included in the stated execution period of 4–5 business days and shall be considered additional working time.

10.2 Inspection, Notification of Defects and Warranty

Towards Entrepreneurs (§ 1 Austrian Commercial Code – UGB)

The entrepreneur is obliged to inspect the delivered services without undue delay upon receipt.

Recognizable defects must be notified in writing without undue delay (§ 377 UGB).

Hidden defects must be notified in writing immediately after their discovery.

If notification is not made in due time, the services shall be deemed approved and warranty claims shall be excluded.

The warranty period shall be 12 months from delivery, to the extent permitted by law.


Towards Consumers (§ 1 Austrian Consumer Protection Act – KSchG)

The statutory warranty provisions of the Austrian Civil Code (ABGB) shall apply.

The statutory warranty period shall be 2 years from delivery.

The consumer is requested to notify obvious defects within a reasonable period; however, failure to do so shall not affect the statutory warranty rights.

10.3 Data Retention

The final project approved by the client shall be stored for a period of 2 years to enable renewed access to the final files if necessary.

Editable working files (project files enabling further modifications) shall be stored for a period of 3 months from project acceptance.

After expiry of this period, further processing, modification or reconstruction of the project cannot be guaranteed and may only be possible upon renewed engagement and separate remuneration.

11. Confidentiality and Data Protection

Processing of personal data is carried out in accordance with applicable data protection regulations (GDPR). Detailed information is provided in our Privacy Policy.

12. Applicable Law and Jurisdiction

All legal relationships between 3DPlan.online and entrepreneurs are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is the registered office of 3DPlan.online.

13. Miscellaneous

13.1 Force Majeure

3DPlan.online is not liable for delays or non-performance caused by force majeure (e.g., natural disasters, power outages, technical failures, governmental actions).

13.2 Severability Clause

If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the original economic intent.
